    Koersdaling valt nog mee ten opzichte van het volume vind ik.
    Als het niet opgevangen word door iemand die belang opbouwt of vergroot hadden we rond de $ 2.30 gestaan denk ik.

    Speelt wat anders! Heb vaker gezien dat er voor goed nieuws de koers in elkaar getrapt werd om belang te vergroten!

    Ik koop nog wat bij ;)

    Een laatste verkoop van een deel van mijn positie in RVP. Ik heb nu nog ongeveer 25% van mijn portefeuille in RVP zitten. Hiermee ga ik wachten op het nieuws over de rechtszaak tegen BDX.
    Mijn oorspronkelijke 100%, 75% en 50% positie in RVP vond ik toch wat aan de hoge kant gezien het feit dat het zo lang duurt voor er nieuws komt, en omdat er toch een (kleine) kans is dat het nieuws minder goed is dan we verwachten.

    Law360, New York (July 07, 2014, 2:57 PM ET) -- The Federal Circuit ruled Monday that Becton Dickinson and Co. must pay all of a $5 million damages award against it in a syringe patent case, even though the infringement verdict was partly reversed three years ago, since the company never argued for lower damages in the prior appeal.
    In the latest twist in a long-running case where Retractable Technologies Inc. accuses Becton of infringing its patents, the appeals affirmed a judge's denial of Becton's motion to modify a jury's damages award against it based on a 2011 Federal Circuit decision.

    In that ruling, the Federal Circuit partially reversed the jury's finding that two types of Becton syringes infringed and held that only one type of syringe infringed. Becton, which did not request a remand of the damages award if the infringement finding were disturbed, then asked U.S. District Judge Leonard Davis to lower the damages award, but he refused since the issue was not raised in the appeal.

    The Federal Circuit on Monday affirmed, writing that Becton's argument "could have and should have been raised in the previous appeal." Once the Federal Circuit issues a ruling, the so-called mandate rule requires lower courts to strictly comply with it, the court held, so they cannot revisit damages or other issues unless they are specifically instructed to on remand.

    "While this court regularly issues remands when requested and appropriate, or on our own initiative if some but not all products are found on appeal not to infringe, there is no 'normal rule' giving district courts the authority to regularly revisit or recalculate damages that fall within our mandate," the court wrote.

    The verdict form simply asked the jury to award damages if it found infringement, and not to break the amount by down based on various Becton products. The Federal Circuit noted that Becton never objected to that instruction or indicated on appeal that it believed partial reversal would necessitate reducing the award, instead seeking a complete reversal or a new trial.

    "Thus, the $5 million award was within the scope of the [2011] judgment, was incorporated into the mandate without argument, and was precluded from further consideration by the district court," it said.

    The court noted that if Becton had included a "single sentence" regarding damages in its filings in the prior appeal, it could have later sought to modify the award after the decision.

    Becton argued that the syringe on which the infringement finding was reversed far outsold the one where the infringement finding was affirmed, so it would not be fair to let the entire $5 million award stand after the partial reversal.

    The Federal Circuit was unpersuaded, writing that "there is no way to conclude from this record what the significance of that alleged disparity might have been in the jury's deliberations."

    The court also rejected Becton's argument that the mandate rule should account for some principle of fairness, reiterating that the company had fair opportunity to raise the damages issue in the prior appeal.

    "To permit this issue to be revisited anew would be to endorse an end-run around the mandate rule, which we are not about to do," it said.

    Representatives for the parties could not be reached Monday for comment.

    Former Federal Circuit Judge Randall Rader sat on the three-judge panel that heard oral arguments in the case in May. However, since he retired effective June 30, he did not participate in the decision. It was therefore rendered by a two-judge panel of Federal Circuit Judges Alan Lourie and Richard Linn.

    Retractable is represented by Cynthia Timms, Roy Hardin and Mark Backofen of Locke Lord LLP.

    Becton is represented by William Lee, William McElwain, Heath Brooks, Robert Arcamona of WilmerHale and Russell Post of Beck Redden LLP.

    The case is Retractable Technologies Inc. v. Becton Dickinson and Co., case number 2013-1567, in the U.S. Court of Appeals for the Federal Circuit.

    Op het yahoo message board had ik e.e.a. ook al gelezen over deze uitspraak in een andere rechtszaak van RVP tegen BDX. Maakt het niet makkelijk te volgen, twee rechtszaken die tegelijk lopen. Blijkbaar waren er een aantal beleggers op het verkeerde been gezet gezien de forse omzet en de koersstijging tot boven de $3.
    Laten we hopen dat er een keer ook nieuws komt over de $113 miljoen (maal 3?) zaak van RVP tegen BDX.

    Het ging inderdaad niet goed. Inmiddels ben ik een stuk selectiever geworden, en vandaag ging dat al een stuk beter. CounterPath Corporation (CPAH) gekocht voor $1.15. In drie delen verkocht voor $1.39, $1.43 en $1.49. Veel te vroeg verkocht achteraf, koers al op $2.18 geweest ... Maar goed, achteraf is alles makkelijk en van winst nemen (zo'n 25%) is niemand armer geworden. Maar toch een beetje zuur dat ik met een half uur langer wachten 3 keer zoveel winst had kunnen maken.
    Oh ja, ik had CPAH gekocht omdat ze een patent hebben gekregen.

    * Last year, jury found that BDX tried to monopolize and made false claims.
    * RVP vs. BDX litigation will probably be resolved in 2-4 weeks.
    * Judge will probably nix BDX's "judgment as a matter of law" (JMOL) motion.
    * BDX recorded a charge of $340.5 mil, treble the jury awarded damages.
    * RVP is worth about $12.44 per share on the basis of the litigation.
    * The ultimate judgment could equal almost $22 per RVP share.
    * Odds of >$12 are >50%. Odds of >$20 are >0%; RVP <$3 is a bargain.
    * Conservatively, RVP's EV is over twice its current price.

    Heb het idee dat hij dat niet uit zijn duim zuigt en dat het ergens op gebaseerd is!

    Laten we inderdaad maar hopen dat we binnen nu en 4 weken iets horen en dat we vanaf vandaag weer hogere koersen op de borden zien!
